GENERAL TERMS OF SERVICE

These General Terms of Service ("Agreement") are entered into between TechJobsinJapan.com, a job advertising platform operating in Japan (hereinafter referred to as "The Company"), and any employer, company, or individual utilizing the services provided by The Company (hereinafter referred to as "The Client" or “The Employer”). By using the services of TechJobsinJapan.com, The Client agrees to abide by the terms outlined below.


1. INTRODUCTION

TechJobsinJapan.com provides recruitment advertising and job posting services designed to help job seekers find new career opportunities at innovative companies hiring in Japan and to support companies with their recruitment efforts in Japan, promote their career opportunities, increase their volume of candidate applications and attract top talent to their organization. These services include, but are not limited to, job postings, employer branding support, and/or the organization of career events and / or any other related solutions that may be introduced in the future under the TechJobsinJapan.com brand name.


2. EMPLOYER ACCOUNT REGISTRATION AND INFORMATION

Before using the website services, The Employer must provide the following information:

- Company Name

- Representative (Main Contact)

- Job Title

- Email Address

- Phone Number

- Office Address In Japan

- Job Posting Content

- Invoicing details (for billing purposes)

The Client is responsible for ensuring that all information provided during account registration and in job postings is accurate, up-to-date, and free from errors. Failure to do so may result in delays, miscommunication, or other service-related issues for which The Company will not be held liable.

This service is limited to companies operating within Japan.


3. JOB SEEKER ACCOUNT REGISTRATION AND INFORMATION

Before using the website services, Job Seekers must provide the following information (but not limited to):

- Full Name

- Email Address

- Phone Number

- Residence Location

- Resume File(s)

- Any other mandatory fields available on the user profile


4. PROHIBITED ACTIVITIES

All users of the platform agree not to engage in any of the following prohibited activities while using the services of TechJobsinJapan.com:

1) Providing False Information: Registering or creating accounts with false or misleading information, including false company names, job listings, or personal job seekers details.

2) Violating Intellectual Property Rights: Uploading, posting, or sharing any content that infringes on copyrights, trademarks, or other intellectual property rights.

3) Defamation: Engaging in defamation, slander, or libel against specific persons, groups, companies, or organizations.

4) Posting Offensive Content: Posting offensive, harmful, or inflammatory statements or content related to race, ethnicity, religion, gender, or any other protected characteristic.

5) Non-Recruitment-Related Activities: Using TechJobsinJapan.com to distribute information not related to recruitment, such as commercial advertising, unsolicited promotions, or spam.

6) Connection to Anti-Social Forces: The Client must not use the platform if they are currently, or have been in the past five years, associated with any anti-social force, including but not limited to organized crime groups, quasi-members of crime syndicates or other violent or extremist organizations.

7) Registering Multiple Accounts: Creating or registering multiple accounts for the same unique user or company without prior approval.

8) Impersonation: Impersonating companies, recruiters, or candidates that do not exist or falsifying information about companies or job listings.

9) Harassment or Abuse: Using the platform to harass, bully, or threaten other users or third parties.


5. PAY PER HIRE SERVICE

TechJobsinJapan.com offers a unique Pay Per Hire model, allowing companies to advertise their related jobs freely on the platform without any upfront costs. Companies only pay a placement fee upon making a successful hire. This model allows us to eliminate any risk for employers, as fees are only due after a candidate has been successfully placed.

6. DEFINITION AND SCOPE OF A SUCCESSFUL HIRE

A "Successful Hire" refers to any employment contract, including permanent employees, contract workers, part-time staff, interns, and temporary workers. The Client agrees to pay the success fee for any Successful Hire, including:

- Candidates hired for a different position than initially advertised.

- Multiple candidates hired from a single job posting.


7. NOTIFICATION OF HIRE

The Client must notify The Company of any Successful Hire within 10 business days. An invoice will be issued on or shortly after the hire's official start date.


8. CANDIDATE SOURCING ATTRIBUTION

If The Client redirects candidates to its own Applicant Tracking System (ATS), The Client must allow proper attribution by listing "TechJobsinJapan.com" as a source option for candidates during the application process.


9. EMPLOYER AGREEMENT AND CONFIRMATION

Before gaining access to post jobs on the TechJobsinJapan.com platform, Employers are required to sign and confirm an agreement with The Company. This ensures that both parties fully understand and agree to the terms of the service.

The agreement will outline additional important details such as:

- Placement Fees: The pay-per-hire model, which includes a success fee based on the type of job and the candidate’s experience level.

- Candidate Ownership: Guidelines on the duration for which The Company retains ownership of introduced candidates.

- Billing Schedule: Terms regarding payment timelines and invoicing processes.

- Refund Policy: Conditions under which a refund may be granted for certain hires.

Employers will be provided with this document to review, sign, and confirm before any job postings can go live on the platform.


10. ACCURACY OF INFORMATION

While TechJobsinJapan.com strives to ensure the accuracy and quality of information provided by users, The Company must not be held liable for any discrepancies, outdated information, or inaccuracies in job postings, candidate profiles, or other content shared on the platform. The responsibility lies with each user to maintain the accuracy, professionalism, and timeliness of their data.

TechJobsinJapan.com is not responsible for any consequences resulting from a user’s failure to update or provide accurate information.


11. FORCE MAJEURE

TechJobsinJapan.com shall not be held responsible or liable for any failure to provide services due to events beyond our control, including but not limited to:

- Acts of God, natural disasters (earthquakes, floods, typhoons, etc.)

- War, military actions, or civil unrest

- Pandemic or widespread health emergencies

- Government actions or regulations

- Power outages, blackouts, or technological failures

- Strikes, labor disputes, or industrial action

- Any other unforeseen events that prevent the normal operation of our services.

In the event of a force majeure situation, The Company will make reasonable efforts to restore services as soon as it is feasible.


12. SUPPORT & AUDIT ACCESS

The Company may periodically access The Client’s TechJobsinJapan.com account for customer assistance and auditing purposes related to the Pay Per Hire program, ensuring accurate billing. This access is strictly limited to verification purposes and will be treated confidentially.


13. SERVICE CANCELLATION

Either Party may terminate the Agreement with or without cause by providing written notice. Upon cancellation, The Client’s account will be deactivated, and services will be terminated. Any candidates introduced prior to termination remain subject to the terms of this Agreement for up to 12 months from their application date.


14. PRIVACY POLICY AGREEMENT

The Client must agree to and comply with the Privacy Policy of TechJobsinJapan.com. By continuing to use our services, The Client acknowledges and agrees to the terms of the Privacy Policy, which governs the handling of all personal and professional data.


15. GOVERNING LAW AND JURISDICTION

This Agreement is governed by the laws of Japan. Any disputes arising from this Agreement shall be subject to the exclusive jurisdiction of the Tokyo District Court.
